PDP guber primaries: Uneasy calm in Ebonyi as Appeal Court transfers case to FHC Abakaliki for retrial

Contrary to reports in some section of the media, alluding that the Court of Appeal  Abuja on Tuesday , declared Senator Obinna Ogba, as the governorship candidate of the Peoples Democratic Party in Ebonyi, Daily Champion has gathered authoritatively that the Apoeal Court only  ordered the transfer of the case to Federal High Court abakaliki for retrial.

The Appeal Court thereafter set aside the earlier ruling of  FHC abakaliki delivered on 7th June 2022 on the matter, that ordered the submission  of names of  PDP  candidates to INEC.

According to the Appeal Court judgement, “the Federal High Court abakaliki erred in law by its ruling on 7th June 2022, to have given judgement against a party it did not hear.”

“The FHC proceded to make judgement without hearing from parties, the law is clear that a person should be heard before judgement be given.”

Meanwhile, there was compliance to the Appeal court judgement as the case resumed at the Federal High court abakaliki on tuesday.

Addressing newsmen,  Counsel to Senator Obina Ogba, Barrister Nnaemeka Nwonu, said that the PDP were joined today in the retrial.“PDP were joined today, normal practices was to allow the PDP to file practices, we have issues with fair hearing”

In his reaction, counsel to Chief Ifeanyi Odii Barrister Mudi Erhenede, said the FHC court abakaliki  judgement challenging the primary of 4th and 5th June 2022, on two major Grounds .

“We wanted the court to tell us how Sen . Ogba and co got the votes they claimed they got to claim victory in the primaries since 90 percent of the delegates boycotted the primaries.”

Meanwhile, majority of abakaliki residents exhibited indifference to the case.

Respondents interviewed shown no interest in the political melodrama.
